It is often commissioned a private investigator for help when you meet legal problems or would like to indent your doubts. It is really a good choice but you will have to face an important problem before entrust a private investigator, that is, how to make sure that the item will be entrusted to one qualified private investigator?

It is a prudent and complicated thing to choose one qualified private investigator properly, but don’t worry, may be the following our experienced information has some help to you.

Before formally touch with one investigator, first you should consider following factors:

1. It is important to sure that how many years of experience does the private investigator have and how much experience does he have relevant to your particular type of case?

2. You should find out what the licensing requirements are for an investigator in your local state, and make sure it is operated legally.

3. It is important to check out anyone who will be working on your case, their ages, qualifications and professional ethics, etc; also you should pay more attention that how many persons will be participated in this case.

4. It is not the most important whether it is member of any professional organizations or association for investigators, but it is a plus.

When you prepare well above items, the next step you should do is to contact the private investigator, which can be gained through the recommendation from your friend or to search directly from the internet website. It is better to login some professional investigator directory or the website of investigator organization, for usually these information will be opened, such as Pi engine International Directory of Private Investigator .

During touch with the investigator, and according to the previous considered four factors to determine whether this investigator professional or not, besides, also will be referred the quotation and the time to finish the case which will be another important way to determine whether this investigator professional or not. As to the quotation and time, you can contact several private investigators, and compare with them, but remember that the cheapest may be not the best, When you make choice not only to compare the price but also quantity.

Usually there will be following characters for unqualified private investigator or without any aptitude:

1. Not will to reveal the number of fixed telephone, but only mobile number.

2. The quoted price will be lower than others of the industry, and easily to have a bargain.

3. Not will to reveal or have no relative fixed operation place.

4. Feeling poor qualification or reply unprofessional when talking on the phone.

If you meet above four situations, then you should be more caution.

I come from http://www.piengine.com an International Directory of Private Investigator.

If you live in any of these states – New Jersey, California, Colorado, Connecticut, Illinois, Kentucky, Louisiana, Maine, Nevada, Nth. Carolina, Sth. Dakota, Texas, Utah, Washington, and Wisconsin- then you have the right to place a security freeze on your credit file to try to protect yourself from Identity Theft. A security freeze simply means that your credit files cannot be shared with other potential creditors.

To place a security freeze on your credit files, what you have to do is write to each of the 3 credit reporting agencies, Equifax, Experian, and Trans Union. Then when the freeze is placed, a potential creditor who looks at your files will see a message or a code that your file is frozen. This is why many people quite often freeze their credit files only after an incident of ID Theft.

Sounds advantageous if you’re an identity theft victim right? Somewhat. Why you ask? Because financial identity theft represents just one form of identity theft. Unbeknownst to many people, in addition to financial ID theft, there are 4 more types of Identity Theft, which include criminal identity theft, DMV identity theft, social security identity theft, and medical identity theft. And a credit freeze will not protect you from any of these aforementioned forms of ID Theft.

Let’s define the 5 types of ID Theft:

1. Financial ID Theft – otherwise at times known as credit card fraud, but can be far more reaching where bank accounts or loans are opened under your name.

2. Criminal ID Theft – when a criminal assumes your ID and commits crimes under your name. The criminal is subsequently arrested, bonded, and never appears to court. As a result, an arrest warrant is issued under your name.

3. DMV ID Theft – when a criminal assumes a driver’s license under your name for which you are never aware of until the criminal is arrested and his/her true identity is discovered.

4. Social Security ID Theft – when a criminal assumes your name to gain social security benefits or even takes on a job with your ID. Very prevalent with illegal immigrants who use false ID’s and real SS#’s to obtain work.

5. Medical Identity Theft – this form of ID Theft can literally kill you. When a criminal is admitted to a
hospital and obtains medical treatment under your name, all the medical information and medication prescribed is now merged with your medical files through a central database shared
by hospitals and health insurance companies.

So let’s ask the question again. Does freezing your credit files prevent ID Theft from happening to you? As you can now see, the answer is no.

The reality is that there is no magic bullet out there that will prevent ID Theft from happening to you. And whether ID Theft happens or not, is no longer the question of the day anymore. The reality is that it’s only a matter of when it happens, and then to what extent.

So the answer to this dilemma is to maintain vigilant. One of the best ways to keep an eye on your credit is by employing an effective credit monitoring program. But again, credit monitoring only watches out for financial identity theft. That’s why it’s important to also consider taking advantage of a credit restoration program that also includes credit monitoring services. Reason being, when Identity Theft does hit, you won’t have to take the time off from work to make countless of calls to financial institutions, creditors, and collection agencies. The service will do all that for you on your behalf.

By Peter Kennedy

One of today’s most controversial topics, the abortion debate pits the rights of a mother against the rights of a fetus. The most common, clear-cut stances on the issue are “pro-choice” and “pro-life,” which hinge on legal and moral considerations. Another common viewpoint is a more blended pragmatist view, which states that abortion should be prohibited except for specific cases.

“Pro-choice” advocates stress a woman’s right to choose whether and when to terminate her pregnancy. In their view, a woman should have absolute control over her own body and, by extension, over the survival of the fetus within her. The “pro-life” camp argues that life begins at conception and any termination of pregnancy after the formation of the embryo is equivalent to murder.

One may deem abortion immoral, but does that necessarily mean it should be illegal? As with many moral debates, there is an underlying and perhaps more significant legal debate raging, especially in the United States. Roe v. Wade was a landmark 1973 Supreme Court ruling that is still relevant today. The Court voted 7-2 to overturn all state laws banning abortion. The Justices concluded that such laws violate a woman’s constitutional right to privacy. Since then, the moral debate has taken on political significance.

Alternatively, if abortion is morally permissible, does that mean it should be legal in all cases? In response to this question, there exist other viewpoints in addition to the clear cut “pro choice” and “pro life” positions. Indeed, proponents of each argument vary by degree.

For example, some pro-choice advocates believe abortion is no longer morally permissible after the second trimester. Similarly, some pro-lifers allow abortion in extreme cases, such as rape or incest. Roughly two percent of pregnancies occur under these conditions.

The abortion debate lends itself to a larger, overriding question: when must the government intervene in citizens’ personal lives, and when must it avoid doing so?

Affirmative action is one of the most controversial political issues facing America. Most often, affirmative action assists disadvantaged groups by improving placement in higher education and employment, and the term is most often conceived as a program to improve the standing of African Americans. People take several stances on the issue, supporting their opinions with various justifications, such as the need for equality and natural competition. Although it was created to help advance the position of disadvantaged peoples, some view affirmative action as an unfair, and even prejudicial, force in our society.

Institutionalized in 1965 by the Johnson administration, Executive Order 11246 required that federal contractors “take affirmative action to ensure that applicants are employed, and that employees are treated during employment, without regard to their race, creed, color, or national origin.” The 1964 Civil Rights Act and the 1965 Voting Rights Act, both during Johnson’s tenure, helped to ensure the equal treatment of African Americans in the 20th century.

While the Johnson administration institutionalized affirmative action, the struggle for equality actually began a century earlier with the passage of important legislation. In the late 1860s and early 1870s, the 13th, 14th and 15th amendments respectively abolished slavery, guaranteed African Americans citizenship and voting rights. The 1866 Civil Rights Act helped to ensure property rights for African Americans. However, in 1896, the Plessy v. Ferguson Supreme Court Case justified segregation, declaring that African Americans could be “separate but equal,” spurring the rise of prejudicial and racist Jim Crow laws. The consequential 1954 Supreme Court case Brown v. Board of Education overturned Plessy v. Ferguson and helped to undermine segregation, eventually dismantling the largely segregated U.S. society.

Affirmative action was conceived to provide equal advantages to all peoples, and to address past governmental injustices by providing support for groups that have been historically discriminated against. Many people would argue that it is our government’s prime responsibility to correct inequities and to create a more just society.

Nevertheless, many take the view that affirmative action is more of a patch than a cure-all. Opponents of affirmative action argue that affirmative action shares the same purpose as the concept of slavery reparations: it punishes the majority for the misdeeds of earlier generations. Further, while affirmative action may seem to make society more egalitarian, its critics argue that the policies are anti-meritocratic and are, actually, a manifestation of “reverse-racism.”

The affirmative action debate lends itself to some important questions: Does the government have a responsibility to correct social inequities? Does affirmative action accomplish its objective of creating a more just society, or is it simply “reverse-racism”?

By Peter Kennedy

Cloning is the process of creating an exact copy of the original, and recently, “cloning” refers to the replication of living humans and animals. Somatic cell nuclear transfer, as the process is called, involves removing the nucleus from an egg cell and replacing it with the nucleus from a cell of the organism to be cloned. In the past few years, advances have been made in both human and animal cloning. Scottish scientists famously cloned a sheep, and British scientists reportedly cloned a human embryo that survived for five days. Cloning is an extremely controversial subject that forces society to examine the proper limits of man’s control over life.

In 1997, Scottish scientists famously produced a female sheep, “Dolly,” using the process of reproductive cloning. Since that time, other scientists have cloned other species, including cows and rabbits. Most recently, scientists are attempting to reproduce humans through cloning. President Bush and the Republican party are strongly in opposition to human cloning. Conservatively tend to believe that life is a creation, “not a commodity,” and that human cloning would have a disastrous impact on the American moral fabric. In 2002, Congress introduced a bill that would ban human cloning in all forms, imposing a prison sentence and multi-million dollar fine on anyone who attempted human cloning. (The Ban on Human Cloning Act has yet to be passed.)

There are practical considerations to the cloning debate, as well. Most medical experts believe that reproductive human cloning would not produce a health newborn. Indeed, many scientists predict that cloning would produce harmful abnormalities in a baby’s genes. Many scientists and medical practitioners welcome the advance of cloning for individual human cells. This process, called therapeutic cloning, adopts the concept of cloning on a micro scale, to help regenerate broken or diseased body parts. Some politicians, such as Republican Senator Arlen Spector of Pennsylvania, support the idea of therapeutic cloning.

Critics of therapeutic cloning argue that the process should be prohibited, no matter how beneficial the practical applications may turn out to be. The most vocal critics of therapeutic cloning, mainly from religious communities, argue that the destruction of human life, even on cellular level, is a moral offense. These cells form the beginning of human life, and humans do not have the right to destroy life in order to create life. The creation of life, they argue, should be left to God.

The cloning debate lends itself to larger questions, including: Is it immoral to recreate life artificially? Does human life really begin at the cellular level? Should the government interfere with scientific advances that could benefit millions of people?

By Mart Gil Abareta

In today’s age of globalization, workplace discrimination is strictly forbidden by the laws of almost every state. However, there are still several companies that discriminate their employees or usually their applicants because of their race, religion or sexual preference. Remember that it is improper and unlawful for an employer to evaluate or fire an employee based on an illegal issue. And in order to protect the rights of all employees, there are legislations and measures that can help them if they’re experiencing discrimination.

Proving discrimination in the workplace can be a challenging task. You must gather evidences that you actually experienced discrimination from your employer for unacceptable reasons. When you’ve gathered some proofs on your case, finding a lawyer in your area is the next thing to do. Basically, a legal specialist can help you evaluate your situation is you are eligible for a civil lawsuit.

On the part of the employer, you have to be aware of the anti-workplace discrimination laws in your state so that you know how to answer all the accusations of your employee when involved in such situation. It might also be necessary for you to consult an attorney so that you’ll understand if you are really at fault and if how you’re going to answer your employee. Always make sure that you know how to justify the legitimacy of your decision to fire your employee by gathering valid facts, too.

Regardless if you are the accused or the accuser, you’ll probably need the assistance of a legal expert to represent you. I know that most of us go to our respective jobs for the foremost reason of earning a living to make our lives better without actually knowing what anti-discrimination law is all about. This only implies that it is important to give this law even a single thought so that when we are trapped in the same situation, we know what legal actions to take.

Therefore, if you think that you, your friend, or your loved ones have been treated unfairly in the workplace, gather relevant facts first and then don’t think twice to file a lawsuit against the employer. Take note that anti-discrimination laws exist to help these powerless employees when oppressed. You have to make sure that your voce will be heard by seeking legal advice from a legal specialist and knowing what you’re entitled for. This will surely start a bright future for you and your family.

The “compensation culture” has been given a rather bad name over recent years; this is due to the large increase in no win no fee compensation claims not just in the States, but also across the globe. The question is, who is really to blame for this increase in claims?

People seeking such compensation claims have been described as “money grabbers” from a kerb tripping generation, personally I beg to differ, although it is true that there have been (and possibly will be more) false compensation claims from people wishing to make a fast buck, the majority of cases are from genuine victims of personal injury accidents which could have been avoided.

Personal Injury Compensation Claims are often made against organizations or individuals who have been the cause of accidents that should not have happened; with a little more due care and attention the whole incident could have been avoided.

Victims of accidents who have received personal injury due to an accident that was not their fault should be encouraged to make a personal injury compensation claim, this will not only compensate them for any injury or suffering caused, it will also remind organizations and individuals just how important it is to ensure that due care and attention is always made, especially in the working environment!

Has this ever happened to you… You’re at home enjoying your meal and you get a knock at your door. “My name is Jack and I’m calling from (company name), have you or your family had an accident in the last 3 years? If so you could be entitled to personal injury compensation?”

Now for that moment what are you thinking? Are you looking back over the last 3 years to see if you or your family have incurred any personal injury? Or are you thinking of slamming the door in their face or setting the dog on them?

The fact is each one and much more has happened to salespeople who go knocking on peoples’ door.

Firstly it’s not polite as they’re reminding you of your accident which could have been traumatic and secondly another personal injury company has said the same thing they are saying 2 days ago.

So in effect it gets frustrating and over time causes anger and you’ll probably take it out on a new recruit who is on their first day at work and you happen to be the first door.

So what is it? A Joke or a Need?

Personal injury has become a joke! Why? There are so many sales people knocking on doors for personal injury claims. In the beginning everyone was like ‘really, can you claim for this’ or ‘you should go and see this company for your injury’. Nobody was aware what was going on but millions of people were claiming for god knows what! Now over the pass few years it upset a few people.

Injured people weren’t getting their compensation. They were getting either a small proportion of the compensation or were paying out of their own pockets. In those days as claims were new, you had to believe everything. It was like, 9 month road to riches. But it never really was riches in your pocket however it was for them as they knew the game. They made it seem like they were helping you but in fact were helping themselves with your money.

Some people even today, who are injured, resist to claim compensation as previous traumatic experience left them in the dark and now confused. ‘I don’t wanna be conned again!’ Well I don’t blame them.

In reality, it’s definitely a NEED. Being compensated for something which wasn’t your fault. It could be a road traffic accident, trip, slip or fall even being assaulted on the streets on your way home. These are the people that don’t find it a joke. Their life has been disrupted by people who they never knew and now don’t want to know.

It takes a lot of energy, especially if there are psychological injuries involved in order to get back on track to a normal life. They either miss out on exams, work, events, holidays and in general ‘their’ own personal lifestyle. Everything happens in an instant… You’re enjoying your life and all of a sudden ‘bang’ your life changes.

You end up paying for medicine, specialists, travel expenses and other bills. So these people don’t think personal injury is a joke as they can reclaim their expenses and be compensated for their loss of enjoyment and injuries.

Stop these canvassers from spoiling the need of personal injury and giving it a ‘bad’ name. Proceed with the right specialists for personal injury can only make your life a hell of lot better.

Make no mistake this time and claim what you are entitled to, by law!

In reality, you tend to be upset and dismayed when a long time has passed after you have filed your personal injury lawsuit but still, nothing good is happening from the time the case has started. In most states, the other party’s insurance company owes you no responsibility to settle quickly. Your case can either be settled or drag on long after the trial is finished. The question now is – what are the reasons for a case to be delayed that long?

There are several things that can slow down the development of your personal injury case. First is discovery which pertains to the desire of the insurance company to know everything about you and your accident. With this, you and you lawyer have to gather up and prepare all the medical bills, records and other relevant documents to your injuries. Some of these must be obtained in a certain way to make them acceptable in court. This can sometimes take time and money.

Second is deposition which refers to the instance where the lawyer/s from the insurance company will ask you in comprehensive details about your injuries, medical history, the accident itself, and the treatment options that you’ve gone through. You’ll most likely to go over a grilling up to the smallest details. Third in line is motion hearing where the insurance company lawyer/s can feel an endless capacity to file motions and go to hearings on motions.

Additionally, mediation which is a typical settlement conference without the formalities of the court can also cause the delay to a court trial. Many courts force lawyers to settle cases prior to trial. Arbitration is a different thing, on the other hand. It’s often a binding mini-trial where an informal presentation of the matters involved in the case is done. Also, trials are usually being scheduled based on the court’s schedule, not the lawyers’ schedule. With this, cases can take years to be scheduled for trial, especially in some major urban areas.

Last but not the least, let’s talk about collection issues. It’s not unusual for someone to have difficulty in collecting the compensation from the insurance company or the person responsible for your injury. The insurance lawyer will have to have a check or draft issued by the company. And before they send you the money, you’ll be required to sign a release document and file some sort of dismissal motion. Obviously, these things also delay payment.

Indeed, the litigation process can really eat up a lot of your time, money and effort. Therefore, it’s sometimes better to settle for less prior to trial than to go through the whole process and then end up with a small settlement or perhaps a bad result at trial.
